Part A — Notice of Privacy Practices
Recreate Behavioral Healthcare of Ohio is committed to protecting the privacy and confidentiality of your health information. This Notice complies with the Health Insurance Portability and Accountability Act (HIPAA), 42 CFR Part 2 (Confidentiality of Substance Use Disorder Patient Records), Ohio Revised Code Chapter 3798, and LegitScript Certification Standards. It explains how we collect, use, disclose, and protect your Protected Health Information (PHI), your rights regarding your information, and how to exercise those rights.
Privacy Statement
Recreate Behavioral Healthcare of Ohio respects the privacy of its clients and website visitors. We do not sell or rent your identifiable health information. Any protected health information you provide is used to deliver services or respond to your inquiries, and is shared only as described in this Notice or as authorized by you. How we handle information collected through our website is described separately in Part B below.
How We May Use and Disclose Your Protected Health Information
We may use and disclose your PHI for purposes related to treatment, payment, healthcare operations, and other situations permitted by federal and Ohio state law:
Treatment. Your PHI may be shared among members of your treatment team to coordinate care, and with external healthcare providers if you require hospitalization or specialized care.
Payment. PHI may be disclosed to your insurance provider or third parties to obtain payment for services.
Healthcare Operations. We may use your PHI to improve our services, train staff, and conduct internal audits.
Legal and Safety Exceptions. PHI may be disclosed as required by law, including reporting abuse, neglect, or threats to safety. In emergencies, such as suicide attempts or harm to others, PHI may be disclosed to relevant authorities or healthcare providers without your prior consent.
Public Health Activities. PHI may be shared with public health authorities to control disease, prevent injury, or address public safety concerns.
Business Associates. We may disclose PHI to third-party vendors who provide services on our behalf (e.g., billing or auditing). All vendors are required to sign agreements to protect your PHI.
Research. PHI may be used for research purposes only with your written consent.
Ohio State Reporting Requirements. We may disclose PHI to Ohio public health authorities as required by law, including reports of contagious or infectious diseases.
Confidentiality of Mental Health Records. In compliance with Ohio Revised Code Section 5122.31, all records related to mental health treatment are confidential and disclosed only in accordance with state and federal laws.
Minor Consent and Privacy. In compliance with Ohio law, minors may consent to certain treatments, and their information will remain confidential unless disclosure is required by law.
Other Disclosures. Any other uses or disclosures of PHI require your written authorization, which you may revoke at any time.
Special Protections for Substance Use Disorder Records (42 CFR Part 2)
Records that would identify you as someone who has applied for or received substance use disorder treatment are protected by federal law and regulations (42 CFR Part 2). We generally may not disclose these records without your written consent, except in limited circumstances permitted by law (such as a medical emergency, certain audits, or as ordered by a court). Federal law also prohibits anyone who receives these records from us from redisclosing them, except as permitted by 42 CFR Part 2.
Your Rights Regarding Your PHI
Access and Copies. You have the right to inspect and obtain a copy of your PHI. Requests must be made in writing. Fees for copies will adhere to the Ohio fee schedule outlined in Ohio Revised Code Section 3701.741.
Request Amendments. If you believe your PHI is incorrect, you may request an amendment in writing. While we may not agree to the amendment, we will document your request.
Request Restrictions. You may request restrictions on how your PHI is used or shared. We may not be able to honor all restrictions unless the services are paid in full out-of-pocket.
Confidential Communications. You may request that we communicate with you through specific methods or at certain locations (e.g., only contacting you at work).
Accounting of Disclosures. You may request a list of non-routine disclosures of your PHI.
File a Complaint. If you believe your privacy rights have been violated, you may file a complaint with our Privacy Officer or the U.S. Department of Health and Human Services (HHS). We will not retaliate against you for filing a complaint.
Our Legal Duties
Recreate Behavioral Healthcare of Ohio is required by law to maintain the privacy of your PHI, provide this notice, and notify you promptly if a breach occurs. In compliance with Ohio law, we will notify the Ohio Attorney General in the event of a data breach involving unauthorized access to electronic PHI. We reserve the right to update this policy; updated policies will be available on our website and upon request.
Part B — Website Privacy & Cookies Policy
This part explains how we handle information collected through recreateohio.com (the “Site”). It applies to visitors to our public website and is separate from the Notice of Privacy Practices in Part A above, which governs protected health information.
Information We Collect
Information you provide to us. Information you choose to give us when you complete a form, start a chat, request information, or call us — such as your name, email address, phone number, and the content of your message.
Information collected automatically. When you visit the Site, some information is collected automatically through cookies and similar technologies, such as your IP address, device and browser type, the pages you view (including which ad or landing page brought you), and how you moved through the Site.
Cookies and Tracking Technologies
We use cookies and similar technologies to operate the Site, understand how it is used, and measure our advertising:
Strictly necessary — required for the Site to function, including an accessibility tool that helps the Site work with assistive technologies. Always active.
Analytics and performance — Google Analytics 4 (GA4) and Google Search Console, to understand how the Site is found and used.
Advertising and measurement — Google Ads (including conversion tracking) and a click-fraud protection tool, to measure and protect our paid-search advertising.
Call tracking and chat — CallTrackingMetrics, which powers our phone-call tracking and the website chat. It may capture your phone number, call details, and anything you share in a chat, including your name, contact details, and the reason you’re reaching out.
Non-essential cookies (analytics, advertising, and the chat) load only after you consent through our cookie banner. You can change your choices at any time using the “Cookie Settings” link in the footer.
How We Use and Share Site Information
We use this information to respond to your inquiries, operate and improve the Site, and measure and improve our advertising. We share it with the service providers who help us do these things — our analytics, call-tracking/chat, and advertising providers — under agreements that limit their use of the data. We do not sell your personal information for money.
Your Privacy Choices and Rights
California residents have rights under the CCPA/CPRA, including the right to know, access, delete, and correct personal information; to limit the use of sensitive personal information; and to opt out of the “sale” or “sharing” of personal information, including for targeted advertising. To exercise the opt-out, use the “Cookie Settings” link or send a Global Privacy Control signal (see below).
Residents of other states that have enacted comprehensive privacy laws have similar rights to access, correct, delete, and port their personal data and to opt out of targeted advertising and the sale of personal data.

Consumer Health Data (Washington and Nevada Residents)
Because Recreate Behavioral Healthcare of Ohio provides mental health and substance use disorder treatment, information indicating that you have sought or received our services may be considered “consumer health data” under Washington’s My Health My Data Act and Nevada’s SB 370. This section applies to residents of those states. For Washington residents, it serves as our Consumer Health Data Privacy Policy under the My Health My Data Act.
Categories of consumer health data we collect. Contact details you submit (name, email, phone), the content of your inquiry or chat, and the fact of your interest in our treatment services; and, where applicable, identifiers and activity data collected automatically (such as IP address, pages viewed, and which ad or landing page brought you).
Sources. Directly from you when you complete a form, start a chat, or call us, and automatically through cookies and similar technologies when you use the Site.
How we use it. To respond to your inquiry, help connect you with care, operate and improve the Site, and measure our advertising.
How we share it, and with whom. We share consumer health data only with the service providers that help us operate the Site and respond to you — our analytics provider (Google), our call-tracking and chat provider (CallTrackingMetrics), and our advertising providers — under agreements that restrict their use of the data. The categories of third parties are: analytics providers; call-tracking and chat providers; advertising providers; and, where required by law, government, regulatory, or law-enforcement bodies. We do not sell consumer health data.
Consent. Non-essential collection through cookies occurs only after you consent through our cookie banner. Where required by law, we obtain your consent before collecting or sharing your consumer health data.
Your rights. You may withdraw your consent, and you may request to access or delete your consumer health data, by contacting us at info@recreateohio.com. We will confirm and honor your request as required by law, and we will not discriminate against you for exercising these rights.
No geofencing. We do not use geofencing to identify, track, or collect data from you based on your proximity to any health care facility.
Global Privacy Control
We honor the Global Privacy Control (GPC) browser signal as a valid opt-out of targeted advertising and the sale or sharing of personal information where required.
Children’s Privacy
The Site is not directed to children under 16, and we do not knowingly collect their personal information through the Site.
Changes to This Policy
We may update this policy from time to time. The “Last updated” date above reflects the most recent version, and material changes will be posted on this page.
